According to Article 49 Employment Law 2013, there are only 2 cases that are not eligible for unemployment benefits:
- Unilaterally terminate the labor contract or working contract in contravention of law;
- Be receiving monthly pension or working capacity loss allowance.
In addition, according to Article 16 Decree 28/2015/ND-CP, one of the following documents is required when submitting for unemployment benefits:
- Resignation decision,
- Layoff decision,
- Dismissal decision.
Therefore, if you are fired or laid off, you are still entitled to submit for unemployment benefits in accordance with the law.
