According to Article 46 Employment Law 2013, the deadline for submitting for unemployment benefits is 3 months from the date of termination of the labor contract or working contract.
For some reason, you cannot submit on time. In case of submitting later than 3 months from the deadline, you will not be able to receive unemployment benefits in this time.
Even so, you won't lose unemployment benefits. The number of months you have paid unemployment insurance premium but have not receive in this time will be added to your next time.
For example:
- In this time, you have paid unemployment insurance premium for 2 years and 6 months and you did not receive unemployment benefits.
- In the next time, you continue to pay unemployment insurance premium for 1 year and 6 months and terminate the labor contract.
- Thus, the unemployment insurance premium that you pay in both times is 4 years, corresponding to 4 months of unemployment benefits. You do not lose 2 years and 6 months of paying unemployment insurance premium in the first time due to not submitting on time.
